Seeking Justice for Camp Lejeune Water Contamination Victims
Dedicated West Virginia Attorneys Fighting for Compensation
For decades, the water supply in the U.S. Marine Corps Base Camp Lejeune in North Carolina was tragically contaminated with hazardous, cancer-causing chemicals. From 1953 to 1987, service members and their families unknowingly consumed and used this tainted water. Today, countless individuals face severe health issues tied to this exposure. While veterans may now be eligible for VA disability benefits, recent developments, including the Camp Lejeune Justice Act, provide an avenue for filing full personal injury lawsuits. The Mountaineer Criminal Law Group is here to represent victims in these claims, offering expert advocacy to secure the justice and compensation they deserve.
Health Problems Linked to Camp Lejeune’s Contaminated Water
The Veterans Administration recognizes several diseases and conditions presumed to be caused by exposure to Camp Lejeune’s water. If you or your family lived on the base during the specified time frame, you may have suffered from one or more of these conditions:
- Bladder cancer
- Breast cancer
- Esophageal cancer
- Female infertility
- Hepatic steatosis
- Kidney cancer
- Leukemia
- Lung cancer
- Miscarriage
- Multiple myeloma
- Myelodysplastic syndromes
- Neurobehavioral effects
- Non-Hodgkin’s lymphoma
- Renal toxicity
- Scleroderma
Many affected individuals have also raised concerns about additional health conditions potentially linked to the toxic substances present in Camp Lejeune water.
The PACT Act and Justice for Veterans
The Honoring Our Promise to Address Comprehensive Toxics (PACT) Act, also referred to as the Camp Lejeune Justice Act of 2022, was passed to address the negligence at Camp Lejeune. This legislation empowers veterans, their families, and others affected to file lawsuits and seek damages for harm linked to the contaminated water.
The law has introduced a streamlined process, called the “Elective Option,” for resolving these claims. Under this program, settlements are allocated by tiered compensation categories, depending on the type of condition and time spent exposed to Camp Lejeune water:
Compensation Tiers
- Tier 1: Diagnosed presumptive conditions are eligible for settlements of $450,000, $300,000, or $150,000, based on exposure time (over 5 years, 1-5 years, or 30-364 days, respectively).
- Tier 2: Possibly related conditions qualify for settlements of $400,000, $250,000, or $100,000, determined by the same exposure timeframes.
- Death Claims: Victims’ loved ones may receive an additional settlement of $100,000.
The Mountaineer Criminal Law Group can help you compile and present the necessary documentation to ensure your claim meets these eligibility requirements.
Eligibility for Filing a Camp Lejeune Lawsuit
To initiate a negligence lawsuit related to a Camp Lejeune-related illness, you must demonstrate one of the following criteria involving exposure to the water supply on the base:
- Direct Exposure: You lived, worked, or were otherwise exposed at Camp Lejeune for at least 30 days in total between August 1, 1953, and December 31, 1987.
- Prenatal Exposure: Your mother lived, worked, or was otherwise exposed under similar conditions while pregnant with you during the same timeframe.
It is important to note that these lawsuits under the PACT Act do not impact a claimant’s ability to access VA benefits associated with Camp Lejeune.
